ESTIMATES, PAYMENTS, LIENS, WARRANTIES

PAYMENTS & LIENS
Payments are due at the time of service as invoiced. Customer grants to SEA Marine the right to assert a lien against the vessel or other property on which SEA Marine performs work. Customer acknowledges SEA Marine’s right to impound and seize any vessel or other property for which an outstanding balance is more than 120 days past due. Upon payment in full, such lien shall be automatically satisfied and released. SEA Marine shall be entitled to its attorney’s fees, costs and/or collection fees in any collection action or lawsuit to collect any amount owing SEA.
SEA Marine warranties its workmanship labor for a period of 12 months after completion. Any claim against SEA Marine for workmanship must be asserted within 30 days after the alleged defect is discovered. To the extent SEA Marine approves of work to correct a valid workmanship claim, the work must be performed by SEA Marine at SEA Marine’s facilities in Port Townsend, WA. Any warranty is void If SEA is not allowed to test and/or sea trial a vessel with work involving propulsion, electronics, electrical, rigging or appliance installation. Work with an unpaid balance is not warrantable.
DISCLAIMER OF WARRANTIES. SEA MARINE IS A VENDOR AND NOT A MANUFACTURER. SEA MARINE ASSIGNS TO THE PURCHASER ANY MANUFACTURER’S WARRANTIES. SEA MARINE DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL SEA MARINE BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. THE SOLE AND EXCLUSIVE REMEDIES IN THE EVENT OF ANY BREACH OF WARRANTY ARE (1) A CLAIM FOR RETURN OF THE GOODS AND REFUND OF THE PURCHASE PRICE; OR (2) REPLACEMENT OF THE DEFECTIVE PRODUCT.
